No Doubt's case against Band Hero's publisher, Activision, is going to get a trial in front of a jury.

The band originally filed the suit in November of 2009 claiming that Activision misled the music group over how their likenesses would be used in the game. They claim Activision never told them that they would be used as unlockable avatars for completing certain aspects of the title that could be used to perform other songs not normally performed by No Doubt. They described the feature as a "a virtual karaoke circus act" in their lawsuit.
